FAQ

Estate Administration

What is a Will?

A Will is a legal document that specifies how a person’s assets and estate should be distributed after their death.

What is an Executor?

An Executor is a person appointed in a will to manage and carry out the deceased’s wishes regarding their estate.

What is Probate?

Probate is a court supervised process that ensures that the deceased’s estate is managed and distributed according to their wishes and legal requirements.

When someone dies without a Will in Canada, they are considered to have died “intestate.” The probate process may still apply, and the distribution of their estate follows the rules set out by provincial or territorial intestacy laws rather than the deceased’s wishes.

For detailed guidance, consulting a legal professional who specializes in estate law in the relevant jurisdiction is advisable.

What is a final tax return?

A final tax return is the last income tax return filed on behalf of a deceased person. It covers the period from the beginning of the tax year until the date of death.

What is a clearance certificate?

In Canada, a clearance certificate is a document issued by the Canada Revenue Agency (CRA) that confirms all taxes owed by a deceased person’s estate have been paid. It ensures that the estate has settled any outstanding tax liabilities before distributing assets to the beneficiaries.
